TERMS AND CONDITIONS

1. INTRODUCTION AND ACCEPTANCE

These Terms and Conditions (“Agreement”) constitute a legally binding contract between you (“User”, “you”, or “your”) and SVETOVEN MARKETING, a company registered in Sofia, Bulgaria, VAT Number: BG203425745 (“Company”, “we”, “us”, or “our”), governing your access to and use of the SignalVision platform, including all associated services, applications, bots, and tools (collectively, the “Service”).

BY ACCESSING OR USING THE SERVICE, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS. IF YOU DO NOT AGREE TO THESE TERMS, YOU MUST NOT ACCESS OR USE THE SERVICE.

2. DEFINITIONS

For the purposes of this Agreement:
• “Platform” refers to the SignalVision ecosystem, including @SignalVisionBot, @signalvisionpaybot, @SignalShotBot, SignalManager bots, web dashboard, and any related software or services.
• “Signal” refers to trading information, alerts, or recommendations that originate from third-party sources (such as Telegram channels) and are forwarded by the User to the Platform for processing.
• “Trade Execution” refers to the automated or semi-automated placement of orders on connected cryptocurrency exchanges based on Signals processed through the Platform.
• “API Credentials” refers to the application programming interface keys provided by third-party exchanges (such as Bybit or Binance) that enable the Platform to execute trades on behalf of the User.
• “Affiliate” refers to a User who participates in the SignalVision Affiliate Program to promote the Service in exchange for commissions.

3. NATURE OF THE SERVICE

3.1 Tool, Not Advisor
SignalVision is a technical tool designed to automate the execution of trading positions based on signals provided by the User. The Platform does NOT provide, create, generate, recommend, or endorse any trading signals. All signals processed by the Platform originate exclusively from third-party sources selected and forwarded by the User.

3.2 No Financial Advice
THE SERVICE DOES NOT CONSTITUTE FINANCIAL, INVESTMENT, TAX, LEGAL, OR ANY OTHER FORM OF PROFESSIONAL ADVICE. We do not recommend any particular cryptocurrency, trading strategy, signal provider, or investment approach. The Company is not a registered investment advisor, broker-dealer, or financial planner in any jurisdiction.

3.3 User Responsibility for Signal Sources
You are solely responsible for selecting, evaluating, and verifying the quality, accuracy, and legitimacy of any signal sources you choose to use with the Platform. The Company has no control over, and accepts no responsibility for, the content, accuracy, timing, or reliability of any third-party signals.

4. ELIGIBILITY AND RESTRICTIONS

4.1 Age Requirement
You must be at least eighteen (18) years of age to use the Service. By using the Service, you represent and warrant that you meet this age requirement and have the legal capacity to enter into this Agreement.

4.2 Geographic Restrictions
The Service is intended for Users in jurisdictions where cryptocurrency trading and the use of trading automation tools are legal. You are solely responsible for determining whether your use of the Service complies with applicable laws in your jurisdiction. The Service is NOT available to residents of jurisdictions where cryptocurrency trading is prohibited or where our Service would require specific licensing that we do not hold, including but not limited to:
• People’s Republic of China (excluding Hong Kong and Macau)
• North Korea
• Iran
• Syria
• Cuba
• Crimea region
• Any other jurisdiction subject to comprehensive international sanctions

IMPORTANT NOTICE FOR UNITED STATES RESIDENTS: While the Service is technically accessible from the United States, U.S. Users acknowledge that the regulatory environment for cryptocurrency trading and automation tools is complex and evolving. By using the Service from the United States, you represent that you have consulted with appropriate legal and tax professionals, understand the regulatory requirements applicable to your situation, and assume full responsibility for compliance with all federal, state, and local laws.

4.3 Exchange Account Requirements
To use certain features of the Service (particularly SignalShot for live trading), you must maintain a valid account with a supported cryptocurrency exchange (currently Bybit and Binance). You are responsible for complying with the terms of service of such exchanges and for ensuring that your use of our Service does not violate their policies.

5. SUBSCRIPTION AND PAYMENT

5.1 Free Trial
We offer a free trial that allows Users to test the SignalManager functionality with up to ten (10) demo signals. The free trial is provided on an “as-is” basis and may be modified or discontinued at any time without notice.

5.2 Paid Subscriptions
We offer the following subscription tiers:
• SignalManager: $15 USD per month or $150 USD per year – Includes unlimited demo trading and a dedicated bot.

• SignalShot: $35 USD per month or $350 USD per year – Includes all SignalManager features plus live trading capability on supported exchanges.

5.3 Payment Methods
All payments are processed in cryptocurrency through our payment bot (@signalvisionpaybot). Accepted payment methods include USDT (on TON and BSC networks), USDC, and Bitcoin. Prices are denominated in USD, and the equivalent cryptocurrency amount is calculated at the time of payment.

5.4 No Refund Policy
ALL SALES ARE FINAL. Due to the digital nature of our Service and the provision of a free trial to evaluate the Platform before purchase, we do not offer refunds under any circumstances. By completing a purchase, you acknowledge and accept this no-refund policy. We strongly encourage all Users to fully utilize the free trial period to assess the Service before making a payment.

5.5 Subscription Renewal and Cancellation
Subscriptions do not auto-renew. Upon expiration of your subscription period, you must manually purchase a new subscription to continue accessing premium features. We are not responsible for any interruption of service due to subscription expiration.

6. API CREDENTIALS AND SECURITY

6.1 API Key Requirements
To enable live trading through SignalShot, you must provide API credentials from your exchange account. You must configure these API keys with trading permissions ONLY and NEVER enable withdrawal permissions. The Platform requires only the ability to place, modify, and cancel orders.

6.2 IP Whitelisting
For enhanced security, you must whitelist our server IP address (54.255.247.52) in your exchange API settings. This ensures that only our servers can execute trades using your API credentials.

6.3 Security Responsibilities
You are solely responsible for maintaining the confidentiality and security of your API credentials, Telegram account, and any other access credentials. The Company shall not be liable for any unauthorized access to your exchange account or any losses resulting from compromised credentials, unless such compromise is directly caused by our gross negligence.

6.4 No Withdrawal Access
The Platform cannot and will never withdraw funds from your exchange account. Our Service is designed exclusively for trade execution. If you believe your API credentials have been compromised, immediately revoke and regenerate them through your exchange.

7. RISK DISCLOSURE AND DISCLAIMERS

7.1 Trading Risks
CRYPTOCURRENCY TRADING INVOLVES SUBSTANTIAL RISK OF LOSS AND IS NOT SUITABLE FOR ALL INVESTORS. You may lose some or all of your invested capital. Past performance of any trading signal, strategy, or the Platform itself is not indicative of future results. You should never trade with money you cannot afford to lose.

7.2 Signal Quality Disclaimer
THE COMPANY MAKES NO REPRESENTATIONS OR WARRANTIES REGARDING THE QUALITY, ACCURACY, PROFITABILITY, OR RELIABILITY OF ANY TRADING SIGNALS. Signals are provided by third parties selected by you, and we have no ability to evaluate, verify, or endorse any signal provider. The presence of a signal on the Platform does not constitute a recommendation to trade.

7.3 Technical Risks
You acknowledge and accept the following technical risks:
(a) Execution Delays: Orders may be delayed due to network latency, exchange server issues, or high market volatility.
(b) Slippage: The actual execution price may differ from the intended price due to market conditions.
(c) Exchange Downtime: Connected exchanges may experience outages, preventing trade execution.
(d) API Limitations: Exchanges may impose rate limits or restrictions that affect the Platform’s functionality.
(e) Signal Parsing Errors: Non-standard signal formats may not be correctly interpreted by the Platform.
(f) Service Interruptions: Our Platform may experience downtime for maintenance, updates, or unforeseen technical issues.

7.4 No Guarantee of Profits
WE DO NOT GUARANTEE ANY PROFITS OR RETURNS. The Platform is a tool to automate trade execution; it does not guarantee successful trades. Any statements regarding potential profits made by third parties (including signal providers or affiliates) are not endorsed by us.

8. LIMITATION OF LIABILITY

8.1 Exclusion of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE COMPANY, ITS
DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE
LIABLE FOR:
(g) Any trading losses, regardless of cause, including losses resulting from executed or
non-executed trades;
(h) Any losses resulting from the quality, accuracy, or timing of third-party signals;
(i) Any losses resulting from technical failures, delays, or errors in trade execution;
(j) Any losses resulting from exchange downtime, API issues, or market conditions;
(k) Any indirect, incidental, special, consequential, or punitive damages;
(l) Any loss of profits, revenue, data, or business opportunities;
(m)Any damages arising from unauthorized access to your accounts due to
compromised credentials.

8.2 Maximum Liability
In any event, our total liability to you for any claims arising from or related to this Agreement or the Service shall not exceed the amount you have paid to us for the Service in the twelve (12) months immediately preceding the claim.

8.3 Acknowledgment
You acknowledge that the limitations of liability in this section are a fundamental part of this Agreement and that the Company would not provide the Service without such limitations.

9. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless the Company and its directors, officers, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from or related to:
(n) Your use of the Service;
(o) Your violation of this Agreement;
(p) Your violation of any applicable laws or regulations;
(q) Your trading decisions and their outcomes;
(r) Any third-party claims related to your use of signals or trading activities;
(s) Your violation of any third party’s rights.

10. AFFILIATE PROGRAM

10.1 Program Overview
The SignalVision Affiliate Program allows Users to earn commissions by referring new paying customers. Commissions are set at twenty percent (20%) of each referred sale.

10.2 Affiliate Obligations

As an Affiliate, you agree to:
(t) Promote SignalVision in a truthful and accurate manner;
(u) NOT make any promises of profits, returns, or financial gains;
(v) NOT represent SignalVision as a signal provider or financial advisor;
(w) NOT engage in spam, unsolicited messaging, or deceptive marketing practices;
(x) NOT use misleading testimonials or fabricated results;
(y) Clearly disclose your affiliate relationship when promoting SignalVision;
(z) Comply with all applicable advertising and marketing laws in your jurisdiction.

10.3 Prohibited Promotional Practices

The following promotional practices are strictly prohibited and will result in immediate termination from the Affiliate Program and forfeiture of all pending commissions:
• Making guarantees or promises of profits (e.g., “Make $1000/day”, “Guaranteed returns”);
• Misrepresenting SignalVision as a signal provider or trading advisor;
• Using fake screenshots, testimonials, or results;
• Mass unsolicited messaging (spam) on any platform;
• Impersonating SignalVision staff or official channels;
• Any form of financial advice or recommendation.

10.4 Approved Marketing Messages

Affiliates should focus on accurate descriptions of the Platform’s features:
• “SignalVision is a tool to manage and automate your trading positions.”
• “Forward signals to SignalVision and let it execute trades automatically.”
• “Track and manage your trades in one place with SignalVision.”
• “Risk management tools to help you control your exposure.”

10.5 Commission Payment
Commissions are paid automatically on the first (1st) day of each month in USDT on the TON network. The minimum payout threshold is fifty dollars ($50 USD). Pending balances below the threshold will carry over to the following month. You must configure a valid TON wallet address to receive payments.

10.6 Program Termination
We reserve the right to terminate any Affiliate account and forfeit pending commissions if we determine, in our sole discretion, that the Affiliate has violated these terms or engaged in fraudulent or harmful promotional activities.

11. DATA PROTECTION AND PRIVACY

11.1 Data Collected
We collect and process the following categories of personal data:
• Telegram user information (user ID, username, first name);
• Email address;
• Full name (for invoicing purposes);
• Country of residence;
• VAT number (if applicable, for EU business customers);
• Exchange API credentials (encrypted);
• Trading activity data (signals processed, trades executed, performance metrics);
• Payment transaction information.

11.2 Purpose of Processing
We process your data for the following purposes:
(aa) To provide and operate the Service;
(bb) To process payments and generate invoices;
(cc) To comply with legal obligations (including tax and VAT requirements);
(dd) To communicate with you about the Service;
(ee) To improve and develop the Service;
(ff) To prevent fraud and ensure security.

11.3 GDPR Compliance
For Users located in the European Economic Area (EEA), we comply with the General Data Protection Regulation (GDPR). You have the right to access, rectify, erase, restrict processing, and port your personal data. To exercise these rights, please contact us through the support bot.

11.4 Data Security
We implement appropriate technical and organizational measures to protect your personal data. API credentials are encrypted and stored securely. However, no method of transmission over the Internet or electronic storage is 100% secure, and we cannot guarantee absolute security.

12. INTELLECTUAL PROPERTY

All intellectual property rights in the Platform, including but not limited to software, code, design, trademarks, logos, and documentation, are owned by or licensed to the Company. You are granted a limited, non-exclusive, non-transferable license to use the Service for its intended purpose during your subscription period. You may not copy, modify, distribute, sell, or lease any part of the Service or reverse engineer any software.

13. TERMINATION

13.1 Termination by You
You may stop using the Service at any time. However, no refunds will be provided for any unused portion of your subscription.

13.2 Termination by Us
We may suspend or terminate your access to the Service immediately, without prior notice, if we reasonably believe that you have violated this Agreement, engaged in fraudulent activity, or pose a risk to the Platform or other Users.

13.3 Effect of Termination
Upon termination, your right to use the Service will immediately cease. Sections of this Agreement that by their nature should survive termination (including limitation of liability,indemnification, and governing law) will survive.

14. MODIFICATIONS TO THE SERVICE AND TERMS

We reserve the right to modify, suspend, or discontinue any part of the Service at any time without notice. We may also update these Terms from time to time. Material changes will be communicated through the Platform or via the email address associated with your account. Your continued use of the Service after such changes constitutes acceptance of the modified Terms.

15. GOVERNING LAW AND DISPUTE RESOLUTION

15.1 Governing Law

This Agreement shall be governed by and construed in accordance with the laws of Bulgaria, without regard to its conflict of law provisions.

15.2 Dispute Resolution
Any dispute arising from or relating to this Agreement shall first be attempted to be resolved through good faith negotiation. If the dispute cannot be resolved within thirty (30) days, it shall be submitted to the exclusive jurisdiction of the courts of Sofia, Bulgaria.

15.3 Class Action Waiver
TO THE EXTENT PERMITTED BY LAW, YOU AGREE THAT ANY DISPUTES SHALL BE RESOLVED ON AN INDIVIDUAL BASIS AND NOT AS PART OF ANY CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION.

16. GENERAL PROVISIONS

16.1 Entire Agreement

This Agreement constitutes the entire agreement between you and the Company regarding the Service and supersedes all prior agreements and understandings.

16.2 Severability
If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

16.3 Waiver
The failure of the Company to enforce any right or provision of this Agreement shall not constitute a waiver of such right or provision.

16.4 Assignment
You may not assign or transfer your rights under this Agreement without our prior written consent. We may assign our rights and obligations under this Agreement without restriction.

16.5 Force Majeure
The Company shall not be liable for any failure or delay in performance due to circumstances beyond its reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, strikes, or shortages of transportation, facilities, fuel, energy, labor, or materials.

ACKNOWLEDGMENT AND ACCEPTANCE

By using the SignalVision Platform, you acknowledge that you have read this Agreement in its entirety, understand its terms and conditions, and agree to be legally bound by them. You further acknowledge that you have had the opportunity to seek independent legal advice before accepting these terms.
